This Privacy Policy details all personal information Heska Corporation collects about you; how we use and protect that information; and choices that may be made regarding your personal information. This Privacy Policy applies to Personal Information and other information collected by Heska or its service providers from or about: (i) visitors to, or users of Heska.com and our other websites and mobile applications, (collectively, the “Sites”);  (ii) prospective and current customers; (iii) anyone using Heska hosting and information technology services, such as WiFi service; (iv) users of any mobile-device applications that we offer (such as its iOS and Android applications); (v) job applicants; and (vi) other third-parties that we interact with.

Your visit to and use of the Sites is subject to this Privacy Policy and to our Terms of Use which may be found here: Terms of Use. Heska respects your privacy and is committed to its protection through our compliance with this Privacy Policy.
 
Please read this Privacy Policy carefully to fully understand our practices regarding your information and how we will treat it.
 
The Sites and Privacy Policy were developed for residents of the United States. If you are a resident of another country, please close out of the Site without providing any personal information.

 

Information We Obtain.

The types of personal information that Heska may process (which may vary by jurisdiction based on applicable law) include:

We may also collect information that is related to you but that does not personally identify you (“Non-personal Information”). Non-personal Information also includes information that could personally identify you in its original form, but that we have modified (for instance, by aggregating, anonymizing or de-identifying such information) in order to remove or hide any Personal Information.

Information Collected Automatically. Heska may also collect technical Information about you when you visit our Sites, which your web browser automatically sends whenever you visit a website on the Internet.

 

 

 

 

Information Collected about Friends/Family. Heska may also collect information about your friends and family through your interactions on Sites. Referring friends to our services requires you to send their personal information to Heska. Other instances, such as sharing content, may also require you to send their personal information to us.

Information Collected about Animals. Heska may also collect information about your animal, or animals treated at your clinic, including breed information and veterinary information as required to provide immunotherapy and other veterinary services provided by Heska.

Information Collected from Third Parties. Heska may also collect information about you from other sources to help us correct or supplement our records, improve the quality or personalization of our services to you, and prevent or detect fraud. We work closely with third parties (for example, business partners, service providers, sub-contractors, advertising networks, analytics providers, search information providers, fraud protection services) in an effort to constantly improve our products and services, and may receive information about you from them. It is important and recommended that you read, very thoroughly, the privacy policies and terms inherent to any third party options. Heska is not responsible for how these entities operate their sites or manage your personal information. 

Co-branding. Some of our websites or services may be co-branded and offered in conjunction with another company. If you use such websites or services, both Heska and the other company may receive the Personal Information that’s collected via that co-branded website or service.  Our use of Personal Information collected through such websites or services shall be subject to the Privacy Policy appearing on or in connection with such websites or services. 

Public Forums, Blogs and the Customer Reference Program. Our Sites may feature bulletin boards, blogs or forums. Any Personal Information that you choose to submit via such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages.

Flash LSOs. We use Local Storage Objects (LSOs), including HTML5, to store content information and preferences. We partner with third parties to provide certain features on our site or to display advertising based upon your browsing activity. Various browsers may offer their own management tools for removing HTML5 LSOs. 

Log Files. Log files record website activity on our services and enable us to gather statistics about our users’ browsing habits. These entries help Heska determine (among other things) how many and how often users have accessed or used our services, which pages they’ve visited, and other similar data. 

Clear GIFs. Clear GIFs, sometimes called “web bugs” or “web beacons,” are small electronic images that are placed on a web page or in an email message. We use clear GIFs to monitor user behavior, deliver cookies, collect information, count visits, understand usage and campaign effectiveness, and to tell if a recipient has opened and acted upon an email.

How Heska Uses Your Personal Information

Heska uses your personal information to provide customer service on our products and services, including fulfilling your product orders or personalizing our offerings to you. We also use your personal information to support our business functions, such as fraud prevention, product testing, marketing, and legal functions, or to participate in third party research studies aimed at furthering veterinary research. To do this, we combine personal and non-personal information, collected online and offline, including information from third party sources. For example, in response to your inquiries about a specific product or service offering, a Heska representative may contact you with the information you have requested; in response to your inquiries about a promotion, we will provide applicable materials per your request as well as communications about related products; and in order to deliver the content and services and customer support we believe you will find the most relevant to your request, we will utilize your contact information. 
 
Additionally, we may elect to use personal identifiers to recognize you when you arrive at our Sites via an external link, e.g., such as a link appearing on a third party site or in an email sent to you by Heska Corporation. See also our Cookies and Tools section below.
 
For Business Purposes & To Benefit You: Heska may also use your information in the following ways:

For Special Programs: Special programs, activities, surveys, events or promotions may sporadically be offered via the Sites (“Special Programs”) that require their own specific terms, privacy notices and/or informed consent forms that explain how your personal information (collected via the Sites) will be utilized or managed in connection with said Special Program (“Special Program Terms”). Heska will honor all Special Program Terms with respect to the personal information provided by you. Heska does not make it standard procedure to share your information with third parties, except where needed to administer the Special Programs. . Should any Special Programs require the sharing of your information for purposes of the program, you will be provided with notice of this action and an opportunity to decide not to participate in the program ahead of any final sign-up actions. You may also be offered the opportunity to agree to or opt-out of the sharing of your information with such third party. But, in some instances, it may be necessary to agree to sharing with a third party in order to participate in a particular Special Program. If you consent to said special programs, Heska will share your information with the third party involved. This third party may use your personal information according to the Special Program Terms, but also for their own purposes according to the third-party entities’ own Terms and Conditions. Heska strongly recommends in these cases that you review both the Special Program Terms and any applicable third party policies and terms of use before participating.
 
To Identify Those Who Benefit from/Recommend Our Products/ Services: From time to time, those who have business relations or who have benefitted from or recommended Heska’s products and services may be contacted by us, e.g., veterinary professionals or those affiliated with the veterinary industry.
 
In Aggregated or De-Identified Form: Aggregation and/or de-identification of heska.com visitor data may occur for various business purposes including development of products and services and/or improvement activities.

Employment Applications. We love when people apply to join the Heska team! In connection with any job application or inquiry, you may provide us with data about yourself, including your educational background or resume and other information. We may use this information throughout Heska for the purpose of employment consideration. We will keep the information for future consideration unless you submit a request for us to delete it, and we will delete all information we are not otherwise required by law or regulation to keep.

Promotional Messaging or Advertising. Heska uses your contact information to recommend products and services that might be of interest to you, to send you marketing and advertising messages such as newsletters, announcements, or special offers or to notify you about our upcoming events. We also use your contact information to contact you about any survey, sweepstakes or contest you may have entered.

Interest-Based Advertising

On our Sites, we may obtain information about your online activities to provide you with advertising about services tailored to your interests. This section of our Privacy Policy provides details and explains how to exercise your choices.

You may see our ads on other websites because we use third-party ad services. Through such ad services, we can target our messaging to users considering demographic data, users’ inferred interests and browsing context. These services track your online activities over time and across multiple websites by collecting information through automated means, including through the use of cookies, web server logs, web beacons and other similar technologies. The ad services use this information to show you ads that may be tailored to your individual interests. The information ad services may collect includes data about your visits to websites that serve Heska advertisements, such as the pages or ads you view and the actions you take on the websites. This data collection takes place both on our Sites, and on third-party websites that participate in these ad services. This process also helps us track the effectiveness of our marketing efforts.

Our Sites are not designed to respond to “do not track” signals from browsers.

Disclosure of Personal Information to Third Parties

Disclosure for Business Purposes. Other companies and individuals may be retained by Heska to perform services or other business functions on Heska’s behalf. We may collaborate with said companies and individuals with respect to particular products or services (collectively, “Providers”). Providers may include, but are not limited to, data analysis firms, credit card processing companies, customer service and support providers, email and SMS vendors, SaaS PBX, Contact Center Solution, web hosting and development companies, distributors and fulfillment companies. Providers also include our co-promote partners for products that we jointly develop and/or market with other companies. We may share information with Providers. Certain Providers may collect information on our behalf through our Sites. We also may disclose personal information with your consent or as directed by your representative.

Disclosure of Personal Information for Legal and Safety Reasons. Heska may be required to disclose personal information to the authorities, including law enforcement agencies, government agencies, or legal entities. We may also disclose information where required by law, litigation, or as a matter of national security to:

How We Protect Personal Information

We maintain administrative, technical and physical safeguards designed to protect the personal information you provide against accidental, unlawful or unauthorized access, destruction, loss, alteration, disclosure or use. No measures will ever provide 100% security. As such, Heska does not guarantee that your personal and other information will be secure from theft, loss, or unauthorized access or use and we are not responsible for any damages or liabilities relating to any such incidents to the fullest extent permitted by law. Where required under law, we will notify you of any such loss, misuse or alteration of Personal Information that may affect you so that you can take the appropriate actions for the due protection of your rights. Users are responsible for maintaining the secrecy of their own passwords. If for any reason you determine your interaction with Heska.com is no longer secure (for example, if you feel that the security of any account you may have with us has been compromised), please contact us at privacy@heska.com, to notify us immediately of this possibly breach of your security.

To Protect Personal Information by Third Parties.
We require that our third-party service providers and channel partners agree to keep all confidential information we share with them and to use the information only to perform their obligations in the agreements we have in place with them. These third-party service providers and channel partners are expected to maintain privacy and security protections that are consistent with Heska’s privacy and information security policies. While we provide these third parties with no more information than is necessary to perform the function for which we engaged them, any information that you provide to these third parties independently is subject to their respective privacy policies and practices.

Data Retention and Storage

Heska retains your information for business purposes, for as long as your account is active, and/or as long as is reasonably necessary to provide you with our products and services. Heska will also retain your information as reasonably necessary to comply with our legal obligations, resolve disputes and enforce our agreements. We may also retain cached or archived copies of your information for a reasonable period of time.

Unfortunately, however, no system or online transmission of data is completely secure. We cannot guarantee the security of information transmitted to our services. To that end, Heska will notify users of a data breach when Heska determines that is reasonably necessary in accordance with applicable law. Any transmission is at your own risk and Heska expects that you will use appropriate security measures to protect your information.

Depending on your geographic location, and internet connection, your personal information may be accessed/processed/transferred from or between the United States and other countries which may reduce the level of protection of your personal information from the level maintained in your country of residence. However, Heska will handle your personal information in accordance with this Privacy Policy regardless of where your personal information is stored/accessed.

Choice: Your Privacy Rights

Heska gives you choices about the ways we collect, use, and share your Personal Information. To update your preferences, limit the communications you receive from us, or submit a request, please contact us as indicated in the “How To Contact Us” section of this Privacy Policy. You can unsubscribe from our marketing mailing lists by following the “Unsubscribe” link in our emails or contacting us as specified in the “How To Contact Us” section below. We will apply your preferences going forward.

You can choose what contact and financial information will be stored in your account and preferences. However, if you choose not to provide certain details, some of your experiences with us may be affected. If you would like to know what Personal Information we hold about you, you may submit a request to us by using the web form available at www.Heska.com/opt-out. We will supply Personal Information about you that we hold in our own files within the reasonable timeframes stipulated by law.

Promotional Offers from Heska. If you do not wish to have your e-mail address/contact information used by the company to promote our own or third parties’ products or services, you can opt-out by using one of the methods described above in ‘Use of Collected Personal Information: Ability to Opt-Out’.

Mobile services. Some of our mobile services use your device’s location information. You can adjust the settings of your mobile device at any time to control whether your device communicates this location information. We may also offer additional controls on our use of your mobile location information.

How We Respond to Do Not Track Signals  

Do Not Track is a privacy preference that users can set in their web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user. Heska has met the obligations of the California Do Not Track legislation by accepting DNT no-track requests, as exemplified by the following protocols:

Access to and Correction of Personal Information.

Heska provides you many opportunities to access and update your personal information. You can ensure that any account, contact, or financial information is up-to-date and can correct, update or delete inaccuracies to the information by reaching out to your representative and/or logging into your account in our ePay system. If you are having trouble updating this information, you may also email privacy@Heska.com or reach out to your sales representative for help.

Heska will attempt to answer all requests that we correct the data if it is inaccurate or delete it as long as Heska is not required to retain it by law or for legitimate business purposes. Different programs and services may ask for different information including phone numbers, links or preference managers that allow you to inform us of your updates and choices, including opting out of particular communications. For certain programs or services, some amount of minimal communication may be required. In some jurisdictions, in addition to you agreeing to this Privacy Policy, data privacy laws may require us to obtain a separate consent before we send you information that you have not specifically requested. In certain circumstances, your consent may be implied (e.g. where communications are required in order to fulfil your requests and/or where you have volunteered information for use by us). In other cases, we may seek your consent expressly in accordance with applicable laws.

In addition, to protect your privacy, we will require you to prove your identity before granting access to, or agreeing to update, correct or delete your Personal Information and we will only implement requests with respect to Personal Information about you (not anyone else).

Collection of Information from Children.

Heska doesn’t sell or advertise to minors or children, and recognizes the importance of protecting the privacy and safety of children. Therefore, our Sites are directed towards the general audience and are not directed towards children. We do not knowingly collect information from anyone under the age of 13 or minors otherwise defined in local law or regulation without verifiable parental consent. If we learn that someone under 13 has provided Personal Information through one of our Sites, we will use reasonable efforts to remove that information from our databases.

Links to Non-Heska Services and Features.

For your convenience and information, our Sites may provide links to other online services, and may include third-party features such as apps, tools, widgets and plug-ins.  These online services and third-party features may operate independently from us. The privacy practices of the relevant third parties, including details on the information they may collect about you, are subject to the privacy statements of these parties, which we strongly suggest you review. To the extent any linked online services or third-party features are not owned or controlled by Heska, we are not responsible for these third parties’ information practices.

California Privacy Rights.

This section supplements the Privacy Policy.  It applies solely to California consumers and addresses personal information we collect online and offline. This section does not apply to Heska personnel or job applicants or information collected about B2B personnel.  This section uses certain terms that have the meaning given to them in the California Consumer Privacy Act of 2018 and its implementing regulations (the “CCPA”). .

 

Personal Information Collection and Disclosure. The following disclosures are intended to provide additional information about (1) the categories of Personal Information we collect, and (2) how and to whom we disclose that Personal Information. Nothing in this section limits our ability to use or disclose information as described elsewhere in this Privacy Policy.

We may use (and may have used in the past 12 months) the above categories of Personal Information for the purposes described in the “How Heska Uses Your Personal Information section above and for the following business purposes specified in the CCPA:

In the past twelve months, we may have disclosed for a business purpose all of the above categories of Personal Information to service providers and as described in the “Disclosure of Personal Information to Third Parties” section above.

Heska has not sold Personal Information in the preceding 12 months. We do not have actual knowledge that we sell personal information of minors under 16 years of age.

 

California Privacy Rights. To the extent provided for by the CCPA and subject to applicable exceptions and exclusions, California residents have the following privacy rights in relation to the Personal Information we collect:

Additionally, under California Civil Code Section 1798.83, California residents may have the right to request the categories of Personal Information we disclosed to third parties for their direct marketing purposes in the year preceding the request and the identities of such third parties.

Exercising Your Rights: California residents can exercise the above privacy rights by contacting EthicsPoint @ Heska.ethicspoint.com, or call 844-777-4730, or emailing us at privacy@heska.com.  To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request. 

Verification: In order to protect your Personal Information from unauthorized access or deletion, we may require you to verify your credentials before you can submit a request to know or delete Personal Information. If you do not have an account with us, or if we suspect fraudulent or malicious activity, we may ask you to provide any of the following Personal Information for verification: full name, address or telephone number.  If we cannot verify your identity, we will not provide or delete your Personal Information.

Authorized Agents: You may submit a request to know or a request to delete your Personal Information through an authorized agent. If you do so, we may require the agent to present signed written permission to act on your behalf and you may also be required to independently verify your identity with us and confirm that you have provided the agent permission to submit the request. To submit a request as an authorized agent on behalf of a consumer, contact the Company at privacy@heska.com and include the nature of your request.  In order to protect the Personal Information from unauthorized access or deletion, we may require you to verify credentials before you can submit a request to know or delete Personal Information. If you are not able to provide sufficient support, or if we suspect fraudulent or malicious activity, we may ask you to provide any of the following Personal Information for verification: full name, address or telephone number and the Company will need to obtain a signed declaration under penalty of perjury that the requestor is the consumer whose personal information is the subject of the request If we cannot verify identity, we will not provide or delete Personal Information.

Financial Incentives: We may offer you a financial incentive to complete a survey or provide information so that we can provide you with a better customer experience. Those surveys have their own terms and conditions that you will have the opportunity to read prior to participating in any such paid survey or giveaway.

How To Contact Us. Customers may contact Heska with any questions, concerns, or inquiries about this Privacy Policy or company data. If you would like to make a formal complaint, please contact privacy@heska.com. All complaints will be evaluated and a reply will be sent as soon as appropriate. Changes to the Data Privacy Policy. Heska may review and update this Privacy Policy periodically without any prior notice. Heska will post a notice to its Sites to inform you of any changes to our Privacy Policy and indicate when it was most recently updated. In the case of material changes that may adversely affect you, the Heska may provide a more direct way of notifying you of changes to this Privacy Policy.
